By accessing GemFundsDatabase or any of its related websites, you are agreeing to be bound by these website Terms and Conditions of Use, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing our site.
1. Scope and use of the subscription
The subscription grants the Customer (being the legal entity that has taken out the subscription) the right to use GEM Business Consult’s database and services (“the Services”). The subscription may not be used by other people or organizations.
Permission is granted to temporarily view the materials (information or software) on GemFundsDatabase website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on the website;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by GEM Business Consult at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
2. Acceptance of the subscription
The subscription terms for the Services are accepted by the Customer by accepting that you have read and agree to the terms of service and that you consent to the terms set forth in the privacy policy.
3. User Membership Obligations
By making a purchase through GEM Business Consult, you represent and agree that:
You are able to enter into this agreement. You have the right, authority, and capacity to enter into the agreement represented by these Terms and to abide by all of the rules and conditions of these Terms;
You are at least 18 years old, and if you are less than the age of consent in the state or jurisdiction where you are located, your parent or legal guardian has reviewed these Terms and granted permission to use the Service. If you are not at least 18 years old, you must discontinue using the Services immediately;
You will be bound by any additional rules or policies published within or with respect to any application provided in GEM Business Consult’s Services; except as exceptionally permitted, you will not copy, redistribute, publish or otherwise exploit material from the GEM Business Consult’s Services without the exceptional prior written permission of the Company.
Paid membership is offered to single/individual users only. Your user ID may be transferred to another member of your organization but not to any individual/party outside of it.
4. Duration and termination of the subscription
The monthly or annual subscription runs from the date the Customer pays and accesses the database to the end of that 30-day period or 12-month period. (For example, if the monthly order is placed January 1, the subscription runs to the end of January or 30th January). At the end of the one month or one year period, the subscription will automatically be renewed for another one month or 12 months, unless terminated by the Customer.
The monthly or annual subscription may be terminated by going to your account and sending an email to info@gembusinessconsult.com, before the expiry of the subscription. The agreement cannot be terminated for a period of subscription already initiated and the Customer will not be entitled to a refund for that subscription period.
A discount is applicable for annual prepayment.
The annual prepaid subscriptions may be terminated by going to your account and sending an email to info@gembusinessconsult.com one month before the expiry of the annual subscription (i.e. for annual subscriptions running April-March, termination must be received before the end of February). The agreement cannot be terminated for a period of subscription already initiated and the Customer will not be entitled to a refund for that subscription period.
5. Refund Policy
Please note that GEM Business Consult offers non-tangible products to its users and it is the responsibility of the customers to fully understand the product/s offered before placing an order.
We do not bear any responsibility and therefore we don’t satisfy any refund/return/exchange requests based on an individual or a company finding a grant or particular funding. Our team works diligently to research, locate and post new funding opportunities. We have no control over which funding opportunity will be available.
Customers cannot request refunds immediately after purchase simply because they did not receive subscription information, activation email and/or are unable to access the page instantly. If any of these problems occur, they can raise a complaint by contacting us at: info@gembusinessconsult.com and we will promptly respond back with the missing details within 48 hours or less. In many cases, such problems occur due to strong spam filters in the email servers of customers that block our messages and we urge customers to check their records properly before reaching out to us.
Within 7 days of the purchase, customers can request a refund under special conditions. To request a refund within 7 days, please contact usat info@gembusinessconsult.com.
Under certain conditions, GEM Business Consult will allow exchanges, substitutions, or if this is not possible a pro-rated refund of a previous purchase if the customer informs us within 7 days explaining the reason for the exchange.
GEM Business Consult will issue a refund only under the following conditions:
– Unauthorized payment made from a third-party account without the knowledge of the account holder.
– If a customer duplicates a payment for a single product.
– If a customer is not satisfied with the purchase and places a request for a refund within 7 days.
In the event that GEM Business Consult is no longer able to operate the GemFundsDatabase due to force majeure (malware, hacking attack), the remaining months of the membership/subscription will not be refunded.
6. Disclaimer
The materials on the website are provided “as is”. GEM Business Consult makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, GEM Business Consult does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites related or linked to this site. Not in any case does GemFundsDatabase guarantee to fund by any donor which is listed on the Website or in any funding strategy document. Our objective is to increase our subscriber’s capacity to raise funds by giving them information regarding funding opportunities.
7. Limitations
In no event shall GEM Business Consult, its principles, or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on GEM Business Consult’s Internet site, even if GEM Business Consult or a GEM Business Consult authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on the website could include technical, typographical, or photographic errors. GEM Business Consult does not warrant that any of the materials on its web site are accurate, complete, or current. GEM Business Consult may make changes to the materials contained on its web site at any time without notice. GEM Business Consult does not, however, make any commitment to update the materials.

However, there may be certain service issues for which GEM Business Consult cannot be held liable for any faults, failures, errors, or issues, including permanent data loss due to third-party server issues.

18. System changes and feature updates
GEM Business Consult informs its GemFundsDatabase users about system changes, feature updates, and other technical news by email. Therefore, all registered users on the GemFundsDatabase platform accept that they are added to the technical newsletter mailing list.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Denmark and the Danish Courts shall have exclusive jurisdiction to determine any dispute concerning these Terms or the subject matter of these Terms.
